Poland: Façade dismantling and new allegations from former stadium contractor in Nowy Sącz Just a few weeks ago, Nowy Sącz city officials assured the public that the construction of the new stadium for Sandecja was proceeding without issues and that the facility would be fully operational by August. However, new concerns continue to cast a shadow over the investment. So, what’s the problem this time?

Protective coating falls short?

According to the portal Rozrywkowy Nowy Sącz, a serious issue has emerged concerning the stadium’s façade. The site supervisor overseeing the construction raised concerns about the quality of the protective coating applied to the façade mesh. The inspector claimed that the protective layer was applied too thinly, which could significantly impact the durability of the material.

The result? The installed façade elements are now being dismantled and returned to the manufacturer for proper finishing according to specifications. The supplier of the material is AceroSystem, a local company from Nowy Sącz, which provided the full set of components along with appropriate documentation. Based on this, the contractor proceeded with installation. However, the supervisor’s inspection revealed that while the material itself was suitable, the coating layer was insufficiently thick. This has led to a halt in progress and further delays in the project timeline.

Mediation fails, Blackbird files complaints with authorities

But the façade is not the only issue affecting the project. Blackbird, the former general contractor for the stadium, has issued a statement accusing the current work being done since October 31, 2023, of violating copyright laws and building permits. The company also announced its intention to disclose detailed information on the construction process, costs, decisions, and operational mechanisms involved.

On April 15, Blackbird formally requested the County Building Supervision Inspector in Nowy Sącz to investigate the legality of ongoing work at the new stadium for Sandecja site. Simultaneously, a request was submitted to the Voivodeship Building Supervision Inspector in Kraków to oversee the inspection process. On April 28, additional letters were sent to the Regional Chamber of Audit, the Regional Prosecutor’s Office, the District Prosecutor’s Office, the Supreme Audit Office, and the Audit Committee of the Nowy Sącz City Council.

Moreover, Blackbird claims that public statements made by city officials and representatives of Nowosądecka Infrastruktura Komunalna do not reflect the actual situation and may mislead the public. Despite extensive efforts, including months of mediation through the Arbitration Court of the General Counsel to the Republic of Poland, the talks ended in failure. The evidence collected—including matters of valuation, unpaid invoices, securities, and work halted after inventory—was ignored or dismissed by the contracting party, the statement reads. We affirm with full responsibility that the actions and omissions of the contracting authority and its representatives constitute gross violations of the law, including principles of public finance discipline, and amount to abuse of power.
