Prescription! Another construction ban

Recent developments regarding the construction of AS Roma's new stadium at Pietralata have taken an unexpected turn. On July 19, 2024, the Civil Court of Rome issued a new order that once again puts into question the continuation of preparatory work on the land earmarked for the stadium.

Just two weeks ago, we reported that the appeal for the prescription had been rejected. The court, in its subsequent decision, recognised the right to possession of the property on Via degli Aromi by its current resident. This results in the prohibition of any research, geotechnical or archaeological work on the site, which could interfere with the ownership relationship associated with the property. This decision is in line with an earlier court decision that concerned another resident of the area.

In response to these decisions, the municipal authorities have taken steps to expedite the expropriation process. Steps were already taken in June to take over the properties and prepare for the possible demolition of the buildings to allow work on the stadium to begin. This procedure covers all properties covered by previous court decisions, including those covered by the latest order.

The coming months will be crucial for the further fate of the project. A meeting is scheduled for August 1, 2024 to consider the residents' request to halt the expropriation action until the Lazio Region Administrative Court issues its final judgment, which is expected in the second half of November 2024. However, the municipal authorities and AS Roma club are confident that they will be able to continue the process as planned, treating the current obstacles as normal administrative complications. AS Roma plans to present the final design for the new stadium at Pietralata before an archaeological survey of the planned construction area is completed. This decision, despite the risks, would allow the project approval process to be accelerated, which is crucial for the progress of the project.

The stadium is to be built in an area rich in finds from the Roman era. To proceed with construction without a full archaeological excavation carries the risk that possible important discoveries could block future implementation during the project. The Soprintendenza Archeologica may then request additional research or changes to the stadium design.

In addition to the archaeological issues, the project must also meet the requirements of the Capitoline Assembly regarding mobility, parking, public transport and environmental protection. Final approval of the project is therefore subject to these criteria being met.
