Spain: Nou Mestalla construction under judicial review — why? The fan association Últimes vesprades a Mestalla has announced it has filed a lawsuit against the city of Valencia over the permit granted to the club in January to resume construction on the Nou Mestalla stadium.

Administrative Inaction

In a statement, the association recalled that as early as December 12 it submitted a report to the city warning of what it considers serious legal and technical deficiencies in the so-called “execution project” presented by the club in October. “Both that initial document and our subsequent notices were ignored,” the statement says, citing three additional written communications.

The group expressed dismay, particularly since — according to them — the city promptly forwarded their objections to the club as part of the construction permit file but never responded to the association, despite having had the official reply since January 23. Due to the silence of the authorities, the fans felt compelled to file an administrative court complaint via “vía de hecho” — a procedure triggered by administrative inaction.

They point to serious irregularities

Últimes vesprades a Mestalla stresses that the documentation submitted by the club does not meet the legal definition of an “execution project” under current regulations. It allegedly includes major technical deficiencies and lacks clarity. Among other issues, they highlight that the project features two alternate roof designs and is explicitly labeled as a preliminary version. They also criticize the use of outdated building codes in structural calculations and the design of the photovoltaic system. Additionally, the roof is projected to have a lifespan of 50 years, whereas the legal requirement is 100 years.

The group also points out the absence of durability tests on materials, which — after 15 years of exposure to the elements — prevents an accurate assessment of the current condition of the existing structure. Another accusation is that the project budget is incomplete, omitting essential elements such as seating, turf, video screens, and the required solar installation — resulting, in their view, in understated construction costs of Nou Mestalla.

Protecting the future?

“If the city did not present technical assessments during the administrative process, it will have to do so in court. The officials and technicians responsible will have to confirm whether the claims are true and justify their silence,” the association stated.

The fans closed by expressing regret that the matter had to go to court. “But we’ve always said we’d do whatever it takes to protect Valencia’s future and ensure public institutions fulfill their duty as guardians of the law and the public interest,” they emphasized.
