Italy: Appeal rejected - AS Roma can work on new stadium The Municipality of Rome has won in the Council of State. The judges of Palazzo Spada have rejected the appeal filed by two residents of the Pietralata district against the eviction order issued by the Capitol. This is the area where AS Roma's new stadium is set to be built.

Months of struggle

The whole issue began in the first weeks of this year. After approving the public interest decree for the construction of AS Roma’s stadium, the Municipality gave the green light for club-appointed technicians to access the land to conduct geological surveys and archaeological excavations. In opposition, two residents filed a civil court motion to protect their property and prevent Roma’s workers from accessing the land.

The Municipality was right

Civil court judges initially accepted the residents’ request as a precautionary measure, and the Municipality, to break the deadlock, had to issue an order for the forced recovery of the land. Now, with the definitive, collective rejection of the suspension request of the eviction order, this stage of the complex legal battle has come to an end. The final resolution is expected between September 12 and 20, when the civil court will decide on the core issue regarding property protection for the two residents, whose initial precautionary request triggered the cascade of eviction orders.

Maurizio Veloccia, the councilor for urban planning, expressed satisfaction with the outcome: Today’s ruling strengthens our position and proves that Roma Capitale was right in the measures it adopted. Excellent news, let’s move forward with AS Roma to implement the final stadium project at Pietralata.
